McClintock & Levier 2009 FamCAFC 62

A mother who admitted six contraventions of orders without reasonable excuse was sentenced to six months imprisonment.  The mother withheld an 11 year old child from the father.  The mother had re-located interstate and enrolled the child in a school under the name of her new partner.  The judge found that this was a serious contravention as the mother had shown a serious disregard for her obligations under the order.  The mother appealed.

The Court re-exercised discretion and suspended the sentence and introduced a good behaviour bond for two years.
