Hester & West 2014 FamCA 78
A father of children aged 9 and 11 years applied for the children to live with him. The father gave evidence that the mother and her new partner had smoked cannabis from a bong, that the mother had phoned asking for money, that a relative of the mother asked him to take care of the children because of her new partner’s drug use, that he received reports that the mother was hospitalized and that the care of the children was being investigated by child protection services, that the mother was quoting from the bible in an unusual manner, and that the mother forgot things she had recently informed a child about.
The judge issued an interim order that the children live with the father and the father have sole parental responsibility.
