A mother of children aged 7.5 years and 5.5 years alleged that the father had been violent throughout their relationship and this had continued after their separation. The alleged family violence included isolation, controlling behaviour, dominance, serious assaults on the mother, stalking, vandalism of property belonging to the mother and her new partner, intimidation, verbal abuse and death threats (personality aggressive).
The judge ordered that:
- the children live with the mother and the mother have sole parental responsibility
- the mother have authority to change the surnames of the children and to re-locate within Australia
- the father be restrained from spending time with the children and restrained from communicating with the children by any means.
