Delacroix & Delacroix 2015 FamCA 349

Three children were involved aged 17, 14 and 11 years.  The children had lived with the mother and spent time with the father.  Communication between the parents was poor to the extent the mother did not inform the father when two children received therapy for mental health conditions, expecting that he would object.   The two older children rarely spent time with the father (contact limited), but the youngest saw the father regularly.  The three children had a good sibling relationship with each other.  The father had not provided primary care for the children.

The judge ordered that the three children live with the mother and that the mother have sole parental responsibility for the two older children.  The judge ordered that the youngest child spent significant time with the father, and that the parents share parental responsibility for this child.
