A child aged 7 years with a diagnosis of mild autism lived with his mother and spent time with his father (autism spectrum disorder). The father applied for an access plan to increase his time with the child.

The Court received evidence from two experts (experts simultaneous).  An expert on autism recommended that time arrangements for the autistic boy be structured, consistent and predictable.  The family consultant recommended that time with the father increase in a graduated approach in three steps that were spaced 6 months apart until the child spent alternate weekends with the father.
