Hodges & Xiu 2014 FamCA 165

The father submitted that the wife had contravened an order made earlier by another judge.  The order granted sole parenting responsibility to the mother and required the mother to arrange annual conferences to discuss the child’s health and education.

The order nominated personnel to be present including each parent and up to four people nominated by parents, but the second judge found that this part of the order was not clear.  The mother had not arranged a conference.

The second judge found that the wording in the original order was vague and that the order was void due to uncertainty and was unenforceable.
